Abstract
The research aims to set out the juristic rulings connected with the mountain environment in Ibāḍī jurisprudence and to reveal the effect of geographic particularity on the application of legal rulings, taking Al Jabal Al Akhdar as an applied case. Its importance lies in bringing out the flexibility of Ibāḍī jurisprudence in dealing with environmental cases and in showing the connection between the fatwa and geographic reality, contributing to a more precise understanding of mountain questions and the effect of custom and necessity upon them. The research follows a descriptive-analytical method, surveying Ibāḍī juristic texts inductively and relating them to the reality of Al Jabal Al Akhdar and its characteristics. Among such rulings are the impurity of certain mountain insects but not their lowland counterparts, the alms due on figs and olives, the ruling on an animal that escapes in the mountains, and the states of ritual consecration in mountain areas. The research is expected to conclude that the mountain environment affects the application of rulings, and that Ibāḍī jurisprudence takes account of necessity, custom and benefit in treating these questions.
