Abstract
The relation of the ethical system to jurisprudence and the fatwa is an essential question, reflecting the degree of coherence of an intellectual system in its legislative and ethical aspects; and inquiry into the influence exerted and received, positively and negatively, within that relation serves to set out the moral philosophy underlying juristic understanding, independent reasoning and the issuing of legal opinions. The ethical system is regulated by, and affected by, the perspective of faith and the conceptions of the world from which one proceeds; and ethics has in turn a central role in the juristic dimension, working in two directions: where it is settled and drawn from the principles of justice and rectitude it disciplines legal rulings so that they do not depart from their elevated ethical frame, whereas where such values are absent from legislative reasoning the latter becomes an instrument contrary to values and to human welfare. Al-Khalīlī was renowned for his critical editing and his encyclopaedic learning, and the researcher traces in his missionary and epistemic system the many features that reveal a substantial ethical discipline within the legislative dimension.
